I bought a lot of 10 Tim Hudson rookie cards on ebay. The auction
ended on July 12th. I have not received the cards. I waited until July
30th before I sent an email asking if the cards had been shipped
yet? He told me yes they were shipped on the 19th and I should
have received them by now.

I waited a couple of more days and told him I had still not received
the cards. He told me that he would post a scan of the receipt.
For 3 days he told me he would post the receipt and he never
did. On the 4th I told him I was thnking about reversing the
payment. On the 5th he posted the receipt. So what would you
do? He has supposedly mailed the cards but I have never received
them.

Fortunately the payment was only 3.04 so I am not out that much
but I would love to have the cards as I am a big Tim Hudson
fan and collector.

File with Paypal and get your money back. It's on the seller to get the cards to you.

I agree also. Just like trades here, the cards need to get to the buyer before the seller REALLY gets the $. File the chargeback.

Definitely file a dispute with paypal before 30 days. If the cards do arrive you can always resend the money to the seller.

I have opened a dispute claim on the item. The one that I have
been hearing from is a woman and she seems a lot more upset with
me now that I am trying to get my money back than she was when
she had my money and I had no cards.

Tell her to take it up with Ebay. You gave her a chance and nothing was done. I have had five transactions reversed for stuff I have never received and am in the middle of another one right now. I'ts what you have to do.

that she mailed the cards. I just never received them. Can I still
make a claim to paypal and get my money back? Or what?

I believe a receipt makes no difference. She needs to show delivery confirmation.

I just did one myself. The seller claimed it was mailed. He also admited that it was a 2nd account and that items were not selling for as much as they should. PP ruled in my favor quickly.

I bet I will see the card listed again soon enough!

Receipt does not matter. If she didn't get some sort of delivery confirmation you will win the case.

You will win even if she does show a dc receipt. Happened to me. I sold on ebay and shipped with dc AND had all the proof needed. Ebay/Paypal still ruled in favor of the buyer stating something to the extent that they want it to be a buyer friendly experience, the buyer is always right and then they took the money right out of my account and refunded it. Fortunately it wasn't a huge amount.

It happened to me twice as a buyer also. Same thing, cards didn't sell as high as they thought and they just said they shipped them. Once with dc and once without dc. I won both cases.

I agree with everyone else.......file and ride it out. You will win.

I escalated it to a paypal claim last night. We will just have to wait and
see. It is not a whole bunch of money but she sure did cop and attitude
with me when I told her I never receive the cards.

She told me she sure was sorry that I hadn't received the cards but
it she refunded the money to everybody that claimed they hadn't
received the cards she would be out a lot of money.

I asked her how many others had not received their cards and
she very quickly informed me that everybody had received the
cards they bought from her. She said she was just talking
about if folks realized I had claimed I didn't receive the cards
and got my money back then more people would pull the same
thing.

So she told me basically that she was sorry I didn't ever receive
the cards but it was my problem.

money and if they had said ok we will ship you something else or
at least tried to work out something with me it would have been
different.

But they took the attitude of they had my money and I didn't have
any cards so it was just my tough luck.

I'm involved in a similar thing, but with a high priced item. I recently filed an ebay claim, but should I file a paypal claim or is an ebay claim the same type of thing since they are both with the same company?

ebay owns paypal you will be fine going thru ebay

You have to escalate it to a paypal claim also. I think you have 2 weeks.
If you don't escalate it to a paypal claim it will just end.
