Sorry I Haven't Been Posting My Successes Lately, But I Am Going To Start Again. It's Been A Very Busy Couple Of Months.

Okay this success really has me a little pissed off, not at you - but because I had given him about 50 cards for a private signing a couple months ago and he has yet to return them. It will be interesting to see what he has to say about it when I move back to Texas and confront him about it. On another note, nice success.
 
Hopefully they show up soon, I have a lot of hissed off people because of this signing not going the way he said it would go...fingers crossed!
 
Just out of curiosity, did you draw up any sort of written contract for him to sign in doing this? It would not be unreasonable to expect a player getting money for his signature to sign an agreement, legally binding him to the task and perhaps even a time frame to get it done.

Sounds like the guy is a flake and didn't make this a priority at all. That is lousy customer service for a fee service being provided! Really, how busy could an ex-mediocre baseball player who is now working in the "real" world like the rest of us be? Any one of us could work a full day, take the kids to basketball practice afterwards, deal with dinner and dishes, watch some TV, get ready for bed and even sign a few items in between! Maybe in a rough week, it would take a few days, maybe two weeks at most!

I didn't participate in the signing, so I have no stake in how it goes, nor am I eagerly awaiting any cards back. I am just curious.

I have actually been trying to get this totally done since Labor Day weekend, so that shows you how his customer service is. No contract or anything was given...he was really nice when I went into his office and simply said Monday was his busy day and couldn't do it, but would get them back out to me soon since I was coming back to Mississippi that day. I guess it could be a police matter for stolen property if he doesn't send it back since my son and some of his workers know I was there that day with the items. I definitely don't be doing this again, if everyone is this difficult...I dunno why anyone does private signings. No wonder I have started to get grey hair.

As for the private signing, Andrew, I'm hoping this means he's getting around to it, so you won't get any more gray hairs. :)

In reading about this, there might be a few things you could do differently if you try to do another private signing with an athlete.

I think that mrmopar's suggestion of a written contract is excellent. With that you could establish the time, date location and other terms for the signing. I think that having the terms in writing might make the athlete take matters more seriously and it gives you stronger legal recourse should matters go poorly.

I think it was a mistake to leave the items with Mr. James. If you are conducting a private signing, it is your responsibility to see that they are signed. By leaving them with him, you have no way of returning items to the owners should they become impatient and wish to cancel the transaction. If the signing never takes place, it's going to be you, and not Mr. James, that will face the brunt of the anger, from those that lost items.

I hope that you have not given him the money yet, as that makes your problems even worse if he never signs the items. Withholding payment until completion of the job can be a powerful motivator.

Lastly, if you are conducting a private signing, I would think that it would be important that you actually witness the signing. You, in effect, serve as the certificate of authenticity, for those items signed at your signing. I have read previously that Mr. James has had his brother sign his mail for him. Without your witnessing the signing, you have no way to guarantee that this didn't happen in this instance.

I hope that this signing turns out well for you. It's terrible that what started out with the best of intentions on your part has turned into a burden for you.
